1. Agreement to Terms

By accessing or using Joud, you agree to be bound by these Terms of Service and all applicable laws and regulations in the Republic of South Africa. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Consumer Rights (CPA & ECT Act)

These terms are subject to the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECT Act). Nothing in these terms is intended to limit your statutory rights under South African law.

3. Purchases and Pricing

  • All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
  • We reserve the right to change prices at any time without prior notice.
  • Your order constitutes an offer to purchase, which we accept only once the item is dispatched.

4. Shipping and Delivery

We deliver throughout South Africa using third-party courier services. While we aim to deliver within the estimated timeframes, Joud is not liable for delays caused by the courier service or unforeseen circumstances (Force Majeure).

5. Hassle-Free Returns for 7 Days

Returns

If you are not completely satisfied, simply return the items to us in their original condition and packaging within 7 days of receipt and we will issue a credit which can be used to place a new order.

Exchanges (Fashion, sportswear and shoes only)

The item must be unworn and unused (other than trials) with the original tags still attached. Packaging should be returned in an undamaged condition with the item.

When does this policy not apply?

If the item is:

  • older than 7 days
  • unsealed, used or missing any accessories
  • a digital product such as an eBook, electronic voucher, gaming code or other digital downloads
  • an audio or video recording or computer software that has been unsealed
  • a newspaper, periodical or magazine
  • a foodstuff, beverage, or other product intended for everyday consumption
  • a nursing or maternity product that has been unsealed, including (but not limited to) breast pumps, bottles, formula, maternity underwear, nappies and wipes
  • a beauty product or fragrance which has been used
  • a product which has been personalized or made to your specifications

6. Intellectual Property

The content on Joud, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like and the trademarks, service marks and logos contained therein, are owned by or licensed to Joud, subject to copyright and other intellectual property rights under the law.

7. User Conduct

You agree not to use the site for any purpose that is prohibited by these Terms of Service. You are responsible for all of your activity in connection with the site. Prohibited activities include, but are not limited to, fraudulent transactions and attempting to compromise the security of the site.

8. Errors, Inaccuracies and Omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

9. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Limitation of Liability

Joud shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our services or products, to the extent permitted by South African law.

11. Governing Law

These terms are governed by and construed in accordance with the laws of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts in that province or country.
